Here is what I dont understand..
245(i) cases are supposed to be hindering forward movement of EB3 cases because of Apr 2001 deadline. I would guess that majority of those cases are from Mexico (I am sure there are some from India as well). Now if that is true, then how come Mexico dates have moved to the month of May 2001 while India EB3 is stuck in April 2001 for the last so many months?

To OP: Why didn't you add your parents to your GC application as your dependents? Check if you can do so now..?
I believe its only for spouse and unmarried kids under 21.

If USCIS works round the clock, working all 200 days of an year, atleast giving green card every day for 100 applicants then from now 3 to 4 years is really optimistic and certainly possible . But I'll say better for to says atleast 5 years from now.

Since you have negotiated 70:30 before joining, you must have agreed to paying H1b Fee. And yours is an H1 transfer and you new how this business works and signed the contract!

IV supports AILF efforts to file the lawsuit and feels that if the lawsuit has a favourable judgement then, it will provide respite to lot of people in the Community IV represents. IV is not an organization which works with one motive and that is to get people out of the greencard mess and IV will support whoever helps its member community.
We feel that revision of Visa bulletin was not correct and AILF is absolutely correct to file a lawsuit against this directive and hence we support AILF in their bid to sue USCIS & DOS

Hi,
The notice doesn't say that I-485 was denied. for I-140, it says notice of Automatic revocation. For I-485 it says Acknowledgement of withdrawl. It looks to me that my previous desi employer actually withdrawn the I-485 application and thats the reason it says the I-140 is automatically revoked.. But how can they withdraw my I-485 application ?

did you file a new g-28? if not do that right away..maybe they denied accidentally

Hi,
Here is my situation. I can apply for I-485 since my labor(PD - Mar 05) has cleared and I-140 has been filed.
But, I have a fiancee and we are getting married in September 2007. She is on H1-B but currently traveling in India.
We cannot get married before September 2007, so, as far as I understand, I cannot add her into my AOS filing right now. And, as far as I understand they are gonna retrogress the dates to oblivion after August 17, 2007.
1. So, my question is, would she have to wait until my priority date become current again before she can add herself into my AOS application?
2. Let's say the answer for question 1 is YES. What happens if due to whatever reason, my I-140 gets approved BEFORE my priority date becomes current, so, in that scenario I wouldn't have been able to apply for her AOS anyway? Then, what are our options?
3. Let's say the answer for question 1 is NO. Then, is there a special processing I need to do to add her since my priority dates will not be current anytime soon because of the retrogression?
Please remember, she DOES carry H1-B on her own.

Hey Guys,
When applying for CP the consulate we can apply to...does it have to be only the one in your home country (American Embassy in Chennai) or can it be the one in the country of last residence.
I have studied and lived in Canada for 3 years before coming to US. I am wondering if i can choose American Embassy in Montreal as my consulate post (country of last residence) or is my option just the consulate post in country of birth
Any thoughts on this greatly appreciated!!!

i upgraded on 6/19.no news yet. saw 2 times lud...
One of my friends who converted his I-140 to PP recently has got a response from USCIS saying that they will take 60 days instead of 15 days to reach to any conclusion. I am not sure whehter they av changed the rules under the hood but ready to announce it.
My I140 is stuck for almost a month now w/o any updates.

Thanks for the link. The robber was indeed targeting a particular group/race...Hispanics. And us Indians look like Hispanics in the eye of African-Americans ( and some whites think we are Arabs, that's a whole different story).
Police also say the suspect in these latest crimes matches the description of a man wanted for a string of robberies apparently targeting Hispanic men in the parking lots of apartment complexes in other parts of west Little Rock.

Yes, flight to DC would have been then recovered from USCIS in the lawsuit against them.. :)
I know your are kidding saimrathi :).
On a serious note though, flight ticket is a small price to pay compared to the other losses that we are suffering because of status quo.
